Terms of Service

These Terms of Service (“Terms”) govern your use of the TradeDraft website platform operated by TradeDraft ABN [to be inserted] (“we”, “us”, “our”). By using our services, you agree to these Terms.

1. Services

TradeDraft provides website design, hosting, and management services for trade and service businesses in Australia. We build, host, and maintain your website on a subscription basis.

2. Account and access

  • You must provide accurate business and contact information
  • You are responsible for maintaining the security of your admin account credentials
  • You must be authorised to act on behalf of the business you register
  • One subscription covers one business website

3. Pricing and payment

  • Pricing is as published on our website at the time of sign-up
  • The one-time setup fee is due at sign-up and is non-refundable once work has commenced
  • Monthly subscription fees are billed in advance via Stripe
  • All prices are in Australian dollars (AUD) and include GST
  • We reserve the right to change pricing with 30 days' written notice

4. Cancellation

  • You can cancel your subscription at any time with 30 days' notice
  • Your website remains live until the end of the current billing period
  • After cancellation, your site goes offline. We retain your data for 90 days in case you change your mind.
  • You can export your content at any time via the admin panel or by requesting an export from us

5. Your content

You retain ownership of all content you provide (text, images, logos, business information). By uploading content, you grant us a licence to host and display it as part of your website.

You are responsible for ensuring your content:

  • Does not infringe any third-party intellectual property rights
  • Is accurate and not misleading
  • Complies with Australian Consumer Law and relevant industry regulations
  • Does not contain unlawful, defamatory, or harmful material

6. Our responsibilities

  • We will build and launch your website within the agreed timeframe (typically 5 business days)
  • We will host your website with commercially reasonable uptime
  • We will keep your website software up to date and secure
  • We will respond to support requests within 1 business day
  • We will not share your data except as described in our Privacy Policy

7. Intellectual property

The TradeDraft platform, including its design templates, code, and systems, remains our intellectual property. Your subscription grants you a licence to use the platform for your website. Custom design work created for your site is licensed to you for the duration of your subscription.

8. Limitation of liability

To the maximum extent permitted by Australian law, our total liability for any claim arising from our services is limited to the fees you have paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded by law.

9. Suspension and termination

We may suspend or terminate your service if:

  • Payment is overdue by more than 14 days
  • Your content violates these Terms
  • Your use of the platform poses a security risk to other users

We will provide reasonable notice before suspension except in urgent security situations.

10. Disputes

These Terms are governed by the laws of Victoria, Australia. Any disputes will first be addressed through good-faith negotiation. If unresolved, disputes may be referred to mediation before any court proceedings.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email with at least 30 days' notice. Continued use of our services after the notice period constitutes acceptance.
